This website at https://www.breastfeedingmed.com.au/ (website) is owned and run by Breastfeeding Medicine Network - Australia/New Zealand Ltd (ACN 634 040 618, ABN 91 634 040 618) (BMNANZ, we, us, our). BMNANZ is an Australian public company limited by guarantee and a registered charity.
These Website Terms and Conditions (terms) set out how you may use the website, including the Practitioner Directory, our forms, and anything we offer or sell through the website. By using the website you agree to these terms. If you do not agree, please do not use the website.
1. About these terms
These terms apply to everyone who uses the website. If you are a BMNANZ member, the Membership Terms and Conditions also apply to your membership. If you register for an event or buy something from us, section 5 applies as well as the terms shown when you register or buy.
Our Privacy Policy explains how we collect and handle personal information, what the website stores in your browser, including cookies, and our use of analytics.
We may update these terms from time to time. See section 13.
2. Health information and emergencies
The information on this website is general information about breastfeeding medicine, about BMNANZ and about the doctors in our directory. It is not medical advice. It does not take account of your or your baby's circumstances, and it is not a substitute for advice from a doctor, midwife, lactation consultant or other health professional who knows your situation. Do not delay seeking care because of something you read here.
In an emergency, call 000 in Australia or 111 in New Zealand. For health advice, call Healthdirect on 1800 022 222 in Australia or Healthline on 0800 611 116 in New Zealand.
BMNANZ does not provide health services or treat patients. Content written for health professionals, including educational material, is general in nature, is not clinical advice for a particular patient, and does not replace professional judgement, current clinical guidelines or approved product information.
3. The Practitioner Directory
The Practitioner Directory lists doctors who are BMNANZ Professional Members and have asked to be listed. The details shown, including services, telehealth, home visits, languages, practice locations and contact details, are supplied by each practitioner, who is responsible for keeping them accurate and up to date.
When the Board approves a listing, it checks that the practitioner holds current registration on the public register of Ahpra, the Medical Council of New Zealand or the Dental Council of New Zealand. We do not otherwise verify the details listed, and we do not endorse, recommend, accredit or refer you to any practitioner. A listing is not a statement about a practitioner's skill, experience or suitability for your care.
Before you see a practitioner, you can check their registration, and any conditions on it, on the public register: Ahpra's Register of practitioners in Australia, or the Medical Council of New Zealand or Dental Council of New Zealand register. Discuss your needs with the practitioner and decide whether they are right for you. Services, fees and availability vary between practices, so check with the practice.
Map positions are approximate. They are placed from address data (G-NAF from Geoscape, and OpenStreetMap data) and may not show the exact building or entrance. The Directions link opens Google Maps, which is a separate service with its own terms.
You may use directory details only to find, contact or refer to a practitioner for care. You must not copy, scrape, harvest or compile directory details, or use them to send marketing or other unsolicited messages. Unsolicited commercial electronic messages are prohibited by the Spam Act 2003 (Cth) and the Unsolicited Electronic Messages Act 2007 (NZ). We may block access to the website by anyone who breaches this section.
If you find an error in a listing, please tell us using the update a listing form on the website. Our Privacy Policy explains how we handle a report about another person's listing.
4. Forms and information you give us
When you use one of our forms, for example to apply for membership, nominate for the Board, apply to join a committee, ask for a change to a listing or contact us, you must give information that is true, complete and current, and keep it up to date. You must have authority to give any information about another person.
Each form shows a collection notice that explains why we ask for the information, who sees it, where it is stored, how long we keep it, and how to ask for access or correction or to complain. The Privacy Policy gives the full picture.
Our forms use Cloudflare Turnstile, a security check that confirms a person is sending the form. Please do not include health information about yourself or anyone else in the contact form. We cannot give medical advice, and the form is not a secure clinical channel.
Where a form asks for a signature, a signature drawn or typed on the form has the same effect as a handwritten signature. We record when you signed and your device's time zone.
We may decline to act on a form that is incomplete, appears to be automated, or contains unlawful or abusive content.
5. Purchases, events, courses and educational materials
This section applies when we offer tickets to workshops, conferences and other events, online courses, educational materials, or other products or services for sale, whether through this website, an online learning platform or a third-party event platform.
Third-party platforms
Registration for our conferences and workshops is currently handled on third-party event platforms (for example EventsCloud). Those platforms have their own terms and privacy policies, which apply to your use of them. The terms we show at registration, and this section, apply to your dealings with us.
Prices, GST and payment
Prices are in Australian dollars unless we say otherwise. BMNANZ is not registered for GST, so no GST is charged and our receipts are not tax invoices. If we register for GST in future, we will say so, and prices shown will then include GST where it applies.
Card payments through the website are processed by Stripe, a payment provider, under Stripe's terms. We never hold your card number. Member rates require a current BMNANZ membership when you book.
Your consumer rights
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). If you buy from New Zealand as a consumer, you also have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 (NZ). Nothing in these terms excludes, restricts or modifies those rights.
Refunds and cancellations
The refund and cancellation terms shown when you register or buy apply in addition to your consumer rights. If none are shown: you may cancel an event registration for a full refund by telling us at least 14 days before the event, and after that we do not refund unless consumer law requires it; you may transfer an event registration to another person by telling us before the event; and an online course or digital material may be refunded in full if you ask before you first access it.
To ask for a refund, email info@breastfeedingmed.com.au. Refunds are paid by the method you used to pay.
Online courses and digital materials
When you buy or are given access to an online course, recording or other digital material, we grant you a personal, non-transferable licence to use it for your own professional development. You must not share your login or access link, let anyone else use your access, record or download the content (except where we provide a download), or copy, publish, sell or redistribute it. Access lasts for the period shown when you buy, or 12 months from purchase if no period is shown.
We may update, replace or correct content, and we may suspend or end your access if you breach this section. If an online learning platform hosts a course, its terms also apply.
Events
We may change an event's program, speakers, venue, dates or format, including moving it online, where reasonably necessary. Changes to the program or speakers do not entitle you to a refund. If we cancel an event, we will refund your registration fee in full. We are not responsible for travel, accommodation or other costs you incur, so please consider travel insurance.
We may photograph and record events for education and promotion. If you do not want to appear in photographs or recordings, tell us when you register or at the event. Recordings of sessions belong to BMNANZ or the presenters. You must not record sessions without our permission.
We expect everyone at our events to behave respectfully and safely. We may refuse entry to, or remove, a person whose behaviour is unsafe, unlawful or seriously disruptive, without a refund.
Continuing professional development
We may describe the CPD hours or activity type that an event or course may count towards. Whether a college, council or other body accepts an activity for CPD is a matter for that body and for your own CPD requirements. BMNANZ does not guarantee that any activity will be accepted.
Educational content
Our educational content is for health professionals. It is general and educational, is not clinical advice for a particular patient, and does not replace your professional judgement, current clinical guidelines or approved product information.
6. Donations
BMNANZ is endorsed as a Deductible Gift Recipient. Gifts of $2 or more to BMNANZ are tax deductible in Australia, and we issue a receipt for each gift. Whether a gift is deductible for you depends on your circumstances. We cannot give tax advice, and the tax treatment of a gift from outside Australia depends on the law of the donor's country.
Donations are used for our charitable purposes. A donation is not refundable unless it was made in error or the law requires a refund. If you think a donation was made in error, email info@breastfeedingmed.com.au within 30 days. If we take donations through a third-party platform, its terms also apply.
7. Intellectual property and the BMNANZ name and logo
All material on the website, including text, images, logos, video, audio, documents, the directory, and the design and layout of the website, is owned by or licensed to BMNANZ and is protected by the copyright and trade mark laws of Australia and other countries, unless we say otherwise.
You may view the website, print or save one copy of a page for your personal or professional reference, and share links to the website. Except as the Copyright Act 1968 (Cth), the Copyright Act 1994 (NZ) or another law allows, you must not otherwise copy, adapt, reproduce, frame, publish, distribute or commercially use any material on the website without our written consent.
The BMNANZ name and logo belong to BMNANZ. You must not use them without the Board's written approval, and you must not suggest that BMNANZ endorses you, your practice or your products or services. Members should read the Membership Terms and Conditions for the rules about using our name and logo.
8. Third-party websites and services
The website links to other websites and uses some third-party services. Map tiles on the Find a Doctor pages load from OpenStreetMap servers, the Directions link opens Google Maps, our newsletter sign-up is hosted by Flodesk, event registration uses third-party event platforms, and card payments will be processed by Stripe. Those services have their own terms and privacy policies.
We do not control third-party websites or services and are not responsible for their content, goods or services, availability or privacy practices. A link does not mean that we endorse the site or service.
9. Using the website responsibly
You must not:
- use the website for any unlawful purpose;
- interfere with, probe, overload or disrupt the website or its security;
- introduce malware or other harmful code;
- use automated tools to scrape or copy the website or the directory;
- impersonate another person or BMNANZ; or
- submit false, abusive, defamatory or unlawful content through our forms.
We may restrict or block access to the website, or decline to deal with you, if you breach these terms.
10. Information on the website
We publish information on the website in good faith on an as is basis. We take reasonable care to keep it accurate and current, but errors can occur, and laws, guidelines and practice details change. We may change or remove content at any time without notice. We do not promise that the website will be available at all times, error-free, secure, or free from viruses or other harmful components.
11. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law, the Consumer Guarantees Act 1993 (NZ), the Fair Trading Act 1986 (NZ) or any other law that cannot lawfully be excluded.
To the extent the law permits: we are not liable for any loss or damage, including indirect or consequential loss, loss of income or loss of opportunity, arising from your use of, or reliance on, the website or its content, including the Practitioner Directory; and where the law allows us to limit our liability for failing to comply with a consumer guarantee about services, our liability is limited to supplying the services again or paying the cost of having them supplied again.
Subject to the paragraphs above, our total liability to you in connection with a purchase is limited to the amount you paid for it, and in connection with any other use of the website is limited to A$100.
Our directors, committee members and volunteers act on behalf of BMNANZ. To the extent the law allows, any claim arising from the website is against BMNANZ and not against them personally.
12. Indemnity
You agree to indemnify BMNANZ against loss, damage, cost or expense, including reasonable legal costs, that we suffer because of your breach of these terms or your unlawful use of the website. This indemnity is reduced to the extent that we caused or contributed to the loss.
13. Changes to these terms
We may change these terms from time to time, for example when we begin selling courses or materials through the website. The current version is always on this page with the date it was last updated. Your continued use of the website after a change is posted means you accept the changed terms. A change does not affect a purchase you made before the change, unless the law requires it.
14. Governing law
These terms are governed by the laws of the Australian Capital Territory and the laws of the Commonwealth of Australia that apply there. You and we submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory and of the courts that hear appeals from them.
The website is made for people in Australia and New Zealand. If you use it from elsewhere, you are responsible for complying with local laws, and we accept no responsibility for the website's compliance with the laws of any other country. If you are a consumer in New Zealand, nothing in this section takes away your rights under New Zealand consumer law, or your right to bring a claim in a New Zealand court or tribunal.
15. Contact
Questions about these terms or the website: email info@breastfeedingmed.com.au or use our contact page.
